Lumina Terms of Use

These Terms of Use ("Terms") apply to the Lumina app ("the App") for iPhone and iPad, provided by Yagiz Ada Umur ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Not medical advice

Lumina offers affirmations, mood check-ins, a gratitude journal and breathing exercises for general wellbeing and inspiration. It is not therapy and does not provide medical or psychological advice, diagnosis or treatment. This includes content about pregnancy and motherhood. Always talk to a qualified professional about your health. If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis line immediately. During breathing exercises, stop if you feel dizzy or uncomfortable.

2. Your licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple devices that you own or control, in line with the Usage Rules of the App Store Terms of Service.

3. Lumina Premium

Lumina Premium is an optional subscription. It unlocks all premium categories, custom affirmations, photo backgrounds and premium fonts in the Theme Creator, and the Daily Affirmation widget. Plans and prices are shown in the App before you buy, in your local currency.

• Free trial: some plans include a free trial for eligible users. If you do not cancel at least 24 hours before the trial ends, it automatically becomes a paid subscription. Any unused part of a free trial ends when you buy a subscription.
• Payment: payment is charged to your Apple Account when you confirm the purchase.
• Renewal: the subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Managing and cancelling: you can manage or cancel your subscription in your device's Settings under your name > Subscriptions. Deleting the App does not cancel your subscription.
• Refunds: purchases are handled by Apple. Refund requests are subject to Apple's policies and can be made at reportaproblem.apple.com.
• Changes: we may add, change or remove features over time. If a subscription price changes, Apple will notify you as required.

4. Your content

Custom affirmations, journal entries, mood check-ins, themes and photos you add belong to you and stay on your device. You are responsible for the content you create. We do not back up your content. If you delete the App or lose your device, your content may be lost permanently, and we are not responsible for that loss.

5. Acceptable use

You agree not to copy, modify, distribute, sell or rent the App; not to reverse engineer it or attempt to extract its source code, except where the law allows; not to bypass or interfere with subscriptions or other protections; and not to use the App for any unlawful purpose.

6. Intellectual property

The App's design, code, the Lumi character, artwork and original texts belong to us and are protected by law. Quotes attributed to other people remain the property of their respective authors and are included for inspirational purposes. Apple, App Store and other trademarks belong to their owners.

7. Third-party services

When you share content to other apps or services, such as Instagram, their own terms and privacy policies apply. We are not responsible for third-party services.

8. Disclaimer of warranties

To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the App will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of the App. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

10. Termination

Your licence ends automatically if you break these Terms. You can stop using the App at any time by deleting it. Remember to cancel any subscription separately in your device's Settings.

11. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the App. Apple is not responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection or privacy laws. If a third party claims that the App infringes their intellectual property, we, not Apple, are responsible for handling that claim. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also follow any applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new "Last updated" date. If you keep using the App after a change, you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Türkiye, without affecting any mandatory consumer protection rights you have under the laws of your own country.
